These Inflo Driver Terms (the "Terms") describe your rights and responsibilities when you use the Inflo app, website or an Inflo-branded charge point (together the "Network") to find, start and pay for electric vehicle charging sessions. You accept these Terms whenever you use the Network, and by continuing to use it after being notified of a change to them. Our Privacy Policy describes how we handle your data, and our Acceptable Use Policy is incorporated by reference.

"We", "divergent", "our" and "us" means the divergent Group Company operating the Network in your location, as set out in the Contracting Entity section of the Online Services Agreement.

The Network and the Operator

Charge points on the Network are owned and operated by third parties ("Operators"), who are our customers. When you start a charging session, the supply of electricity is a contract between you and the Operator of that charge point. We act as the Operator's agent to present their charge points and tariffs to you, to conclude the session, and to collect payment on their behalf. Payment to us discharges your payment obligation to the Operator. The Operator's identity and the applicable tariff are shown to you before each session starts.

We do not supply electricity, and we are not responsible for the availability, condition or performance of any charge point, the electricity supply to it, or the site at which it is located.

Pricing and Payment

Before a session starts, the applicable fees are displayed in the app and may comprise a fee per kWh of energy delivered, a session start fee, a fee per unit of time connected, idle or overstay fees for time connected after charging completes, and a minimum charge per session where the Operator has set one. Where a minimum charge applies, it is shown before the session starts and is payable even if the energy delivered would otherwise cost less. Because the final price depends on energy delivered and time connected, it cannot always be stated in advance.

To start a session you must have a valid payment method on your account. We may reserve an estimated amount against your payment method when a session is authorised, with the final amount settled when the session ends and the reservation released. A receipt for each session is available in the app. If you believe you have been charged in error, you must tell us within 30 days of the session, and we will investigate with the Operator.

You are responsible for sessions started using your account, app, RFID card or other credential until you notify us of any loss, theft or unauthorised use, after which we will block the credential.

Using Charge Points

You must use charge points correctly and in accordance with any instructions displayed at the location or in the app, ensure the charge point and connector are suitable for your vehicle, and comply with any parking restrictions or time limits at the site. Please report any damaged or defective charge point to us through the app so that we can inform the Operator.

Cancellation and Withdrawal

By starting a charging session you request that supply begins immediately. Your right of withdrawal ends when the session completes, and if you cancel during a session you pay for the energy and time already delivered, or the minimum charge where one applies and is higher.

Support and Disputes

We provide first-line support for matters relating to the Network, the app and payment. Matters relating to a specific charge point, site or session outcome are the responsibility of the Operator, and we will refer them to the Operator on your behalf.

Liability

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Subject to that, our liability to you in connection with any session is limited to the amount you paid for that session, and we are not liable for any loss arising from the acts or omissions of an Operator, or for indirect or consequential loss. Your statutory rights as a consumer are not affected.

Changes to these Terms

We may update these Terms from time to time. Where a change materially affects you, we will notify you through the app or by email before it takes effect. Continued use of the Network after a change takes effect constitutes acceptance of the updated Terms.
